SB 88, by Senator Duane Ankney (R-Colstrip), would create a whole new liability for the owners of the Colstrip plant who intend to retire the plant. The bill would require the state DEQ to collect a bond from the owners of the Colstrip plant that would be used to pay for maintenance of the plant regardless of whether or not the owners think the expenditure is prudent and can get reimbursed for the expense from their customers. Plant owners in Idaho and Washington are either not allowed to make investments in the plant that would extend the plant’s life beyond 2025 or are not likely to get reimbursed from customers for such expenditures.  This bill would force DEQ to play referee between the owners and also behave like an owner by forcing them to pay for unwanted and unnecessary investments in an old and unaffordable plant.
