SB 265 by Sen. Steve Fitzpatrick (R-Great Falls) would violate state and federal constitutional law by allowing the legislature to override the original contract between the Colstrip owners and force them to conduct any arbitration regarding conflicts over continued operations at the Colstrip power plant in Montana courts instead of in Spokane courts. None of the owners have their corporate headquarters in Montana and most of them are located in Washington. This is simply an unconstitutional attempt to try and force the continued investments and operation of the plant over the objections of the existing owners.
