SB 237 by Sen. Doug Kary (R-Billings) would eliminate the obligation of NorthWestern Energy’s shareholders to pay a $2.5 million penalty to state and tribal low-income energy assistance programs. A court found that NorthWestern had failed to make a reasonable effort to comply with the community renewable energy provision in the state’s renewable energy standard in both 2015 and 2016. This bill retroactively eliminates this obligation of NorthWestern’s shareholders to support low-income programs for its failure. NorthWestern claims that the law is unworkable, yet Montana Dakota Utility has complied with the law.
