SB 140 by Sen. Keith Regier (R-Kalispell) would eliminate the Judicial Nominations Commission and require that applicants for Montana District Judges and Montana Supreme Court Justices apply directly to the governor. The Judicial Nominations Commission is an independent and non-partisan body that fully vets judicial candidates before forwarding them on to the governor. This bill would upend decades of process and politicize the applications process by making the governor directly responsible for judicial appointments. This bill will result in a less independent and more political judiciary.
This bill has passed the Senate and House, and is heading to the Governor’s desk.
