Before a significant amendment, SB 300 would have created a basic right to use property. This is a broad expansion of property rights that could result in a new takings claim. Amendments fixed the bill.


This bill was amended to remove the problematic language, and MEIC became neutral on the bill.


Passed the Senate Judiciary Committee on a 12-0 vote. Passed the Senate Floor on a 50-0 vote. Passed the House Judiciary Committee on a 17-2 vote. Passed the House Floor on a 73-24 vote. House amendments passed the Senate on a 39-11 vote.

The Goveror failed to take action on the bill within the 10-day timeframe, and SB 300 became law.
