SB 300 would create a basic right to use property. This is a broad expansion of property rights that could result in a new takings claim. Amendments could fix the bill but if the amendments don’t go on the bill the bill should be defeated.

Passed the Senate Judiciary Committee on a 12-0 vote. Passed the Senate Floor on a 50-0 vote. Passed the House Judiciary Committee on a 17-2 vote. Passed the House Floor on a 73-24 vote. House amendments passed the Senate on a 39-11 vote.

SB 300 is on its way to the Governor’s desk.
